terms of service

These terms govern your use of Kaparay. The short version: we run the marketplace, sellers sell their own pieces, your money is held until delivery is confirmed, and we expect honesty from everyone. The long version follows, written to be read.

1.Who we are

Kaparay (kaparay.com) is a UK online marketplace for pre-loved South Asian fashion. You can write to us at enquiries@kaparay.com. Full company details, including our registered name, company number and registered address, will appear here before launch.

By creating an account or placing an order you accept these terms, together with the returns policy, the prohibited items policy and the privacy policy, which all form part of these terms.

2.A marketplace, not the seller

Kaparay provides the platform on which buyers and sellers transact. The seller of an item is the person or business named on the listing, not Kaparay. The contract of sale for each order is between the buyer and that seller; Kaparay processes the payment, holds it until delivery is confirmed, and provides the protections described in section 5.

Two kinds of seller use Kaparay, and the law treats them differently:

  • Private sellers sell pieces from their own wardrobe. Consumer law that applies to businesses does not apply to them, so Kaparay provides its own buyer protection policy on every private-seller order (section 5).
  • Professional sellers (vendors)sell as a business. Every vendor listing is marked "Professional seller", and every vendor storefront shows the business name, address, complaint contact and returns policy. Your statutory rights, including under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, apply in full to vendor orders (section 6).

3.Your account

You need a verified account to buy, sell, message or save. Keep your details accurate and your password to yourself; you are responsible for activity on your account. You must be at least 18 to sell. Selling also requires identity and bank verification through Stripe, our payment provider, before a listing can go live: this is how we make sure every seller can actually be paid.

4.Buying

Prices are in pounds sterling. The total you pay is the item price, postage at the rate you choose, and a flat £1.50 buyer protection fee per order. All three are shown on the listing page before you reach checkout; nothing appears at checkout that was not disclosed on the listing.

Payment is taken when you place the order and held until delivery is confirmed. Each listing is a unique piece, so each order covers one item with its own parcel, tracking and return window. On orders of £200 or more, the fully covered Premium Protected delivery service is the only option: the cover has to match the value of the piece.

5.Buyer protection on every order

The £1.50 buyer protection fee funds a simple promise. Your money is held until delivery is confirmed, plus a 48-hour window for you to raise a problem. You are refunded in full (item, postage and fee) if the carrier confirms your parcel lost, if a not-as-described case is upheld, or if a confirmed counterfeit is found. Disputes are decided by a named person at Kaparay within 3 working days, with written reasons.

Stated plainly, because we would rather you know now: buyer protection does not cover change of mind (you can still return within 14 days, but on private-seller orders the outbound postage and the £1.50 fee are not refunded and you pay the return postage), and it never covers payments made outside Kaparay. Pay by bank transfer, PayPal or cash and there is nothing we can do.

6.Statutory rights on vendor orders

On orders from professional sellers, nothing in these terms limits your statutory rights. Under the Consumer Contracts Regulations 2013 you may cancel a vendor order up to 14 days after delivery and have 14 further days to send the item back; the refund covers the item price, the standard outbound postage and the buyer protection fee, and is made within 14 days of the vendor receiving the return or proof of postage. Return postage is yours, as disclosed before purchase. A model cancellation form is available on request and linked from the returns policy.

Under the Consumer Rights Act 2015, goods from a vendor must match their description. The 30-day right to reject faulty goods, and the remedies that follow it, are honoured beyond the in-app returns window: the in-app flow is the convenient route, never a cap on those rights.

7.Selling

Sellers agree to a short list of non-negotiables:

  • list only items you own and are entitled to sell
  • describe honestly: condition grade, flaws photographed, measurements where they matter, your own photography
  • dispatch with a tracked service within 5 working days of the sale. Orders not dispatched by the end of working day 5 are cancelled automatically, the buyer is refunded in full and the listing is returned to draft
  • nothing on the prohibited items list, and no counterfeits, without exception
  • keep the transaction on Kaparay: arranging payment off the platform is a breach of these terms

Kaparay may remove listings that breach these terms or the prohibited items policy, and reviews listings at and above £300 before they go live.

8.Fees

Listing is free. When a piece sells, Kaparay takes a commission of 10% of the item price: never on postage, never on the buyer protection fee. Buyers pay the flat £1.50 buyer protection fee per order. There are no other fees.

Fee rates are shown before you publish a listing and snapshotted when an order is placed: a rate change never touches an order already in flight. Changes are published before they take effect and apply to future orders only.

9.Payments and payouts

Payments are processed by Stripe; Kaparay never sees or stores your card details. Seller payouts release once delivery is confirmed plus the 48-hourissue window, or sooner if the buyer confirms all is well, and then reach the seller's bank within 3 working days through Stripe (a seller's first ever payout can take up to 7 days while Stripe completes its checks).

If an order is refunded under the returns policy after the payout has been released, the amount owed is recovered from the seller's balance or future payouts. A buyer's refund never depends on that recovery succeeding.

10.Returns and disputes

The returns policy forms part of these terms. In one paragraph: every order may be returned within 14 days of delivery with no seller approval step; not-as-described issues are reported in-app with photos, the seller has 72 hours to respond, and unresolved cases are decided by Kaparay within 3 working days with written reasons. Refund composition by seller type is set out in the policy.

11.Acceptable use

No counterfeits. No items on the prohibited list. No moving payment off the platform. No fake or incentivised reviews (reviews are verified-purchase only). No abusive, discriminatory or threatening conduct towards anyone, including our team. Repeatedly frivolous claims are flagged and may lead to account action.

12.Suspension and appeals

Accounts that break these rules may be restricted or suspended after human review, with a stated reason and a real appeal path: write to enquiries@kaparay.com and a person will look again. Suspension never withholds money already earned on completed orders, except where a specific order is under dispute. A second confirmed counterfeit is a permanent ban.

13.Liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited under UK law, including for death or personal injury caused by negligence, or for fraud. Kaparay is not responsible for the acts or omissions of sellers beyond the protections described in section 5 and the returns policy, and is not liable for loss of profit or business on a marketplace used personally.

14.Changes to these terms

We may update these terms. Material changes are notified by email before they take effect, with the new effective date stated. Continued use after that date is acceptance; if you do not accept, stop using Kaparay and we will close your account on request.

15.Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also rely on the courts and mandatory consumer protections of your home nation.
